Article 81 of the Mental Hygiene Law of the State of New York permits a court to appoint a guardian for an individual it deems to be incapacitated. These cases are brought by family members, friends, nursing homes, hospitals or other members of the public concerned about an individual’s ability to handle their personal or financial affairs. Upon the Court rendering a determination that an individual is incapacitated, an order and judgment will be issued which is specifically tailored to allow the Guardian to meet the needs of the incapacitated person. The Guardian may be granted powers to handle an incapacitated person’s financial affairs, healthcare decisions, living arrangements and many other important things.
